Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the DineFlowBook mobile application, website, APIs, and related services (collectively, the "Service") provided by DineFlowBook ("we", "us", or "our").

By downloading, installing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

DineFlowBook is a restaurant operations platform that helps restaurants and their authorized staff manage bookings, orders, customers, menus, branches, employees, analytics, feedback, and related business workflows. The Service is intended for commercial restaurant use, not for personal consumer dining reservations unless explicitly offered by a participating restaurant.

2. Eligibility and Accounts

  • You must be at least 18 years old and legally able to enter into a binding agreement to use the Service.
  • Restaurant administrators are responsible for creating and managing accounts for their organization and employees.
  • You agree to provide accurate, current, and complete registration information and to keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials, restaurant code, and OTP verification process.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or unauthorized purpose
  • Upload false, misleading, defamatory, or infringing content
  • Attempt to access accounts or data belonging to other restaurants
  • Reverse engineer, scrape, overload, or disrupt the Service or its APIs
  • Circumvent security, authentication, or rate-limiting controls
  • Use the Service to send spam or unauthorized marketing messages
  • Collect guest data without appropriate notice or legal basis

We may suspend or terminate access if we reasonably believe you have violated these Terms or applicable law.

4. Restaurant Responsibilities

If you use DineFlowBook on behalf of a restaurant, you agree that:

  • You have authority to bind the restaurant to these Terms and to enter guest and employee data into the Service.
  • You will comply with applicable laws relating to customer data, marketing communications, food service operations, and employment practices.
  • You will obtain any required consent from guests before storing personal information such as phone numbers, birthdays, or anniversaries.
  • You are solely responsible for the accuracy of bookings, orders, pricing, tax/GST settings, and guest communications sent from your account.

5. Guest and Customer Data

Restaurants enter guest information into the Service for operational purposes. DineFlowBook processes such data on behalf of the restaurant as part of the Service. Our handling of personal data is described in our Privacy Policy.

6. Communications and Third-Party Tools

The Service may support OTP delivery by SMS or email and may allow staff to open external apps such as WhatsApp or the device phone dialer to contact guests. You are responsible for ensuring that communications comply with applicable telecom, messaging, and privacy laws. Third-party services are governed by their own terms and policies.

7. Intellectual Property

The Service, including its software, design, branding, logos, and documentation, is owned by DineFlowBook or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal restaurant operations in accordance with these Terms.

You retain ownership of content you upload, such as menu images and business records. You grant us a license to host, process, and display that content solely to provide and improve the Service.

8. Service Availability and Changes

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, including features, APIs, or supported platforms, with or without notice where permitted by law.

9. Fees

Some features may be offered free of charge during early access or promotional periods. If paid plans are introduced, pricing and billing terms will be communicated separately. Continued use of paid features after notice constitutes acceptance of applicable fees.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT OPERATIONAL DATA WILL ALWAYS BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINEFLOWBOOK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) INR 5,000.

12. Indemnification

You agree to indemnify and hold harmless DineFlowBook from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of another person or entity.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Provisions that by nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

14. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates the latest version. If changes are material, we may provide notice through the app, website, or email. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
